Terms of Service

1. Acceptance

By accessing JamaicaMD or JamaicaMD.com (together, the “Platform”), you agree to these Terms. If you do not agree, do not use the Platform. HealthTech, Inc. (“HealthTech”, “we”, “us”) operates the Platform.

2. Description of service

We provide a technology platform that may include:

• A public directory of healthcare providers and clinics in Jamaica
• Search and listing pages
• Appointment booking and clinic tools when a practice has activated them
• Patient and provider accounts

We do not provide medical care or medical advice. We do not practice medicine. In an emergency, contact local emergency services.

3. Directory listings

Listings may show a professional’s name, specialty, practice location, and a practice contact number. They may be submitted by a practice, compiled from publicly available professional information, or both. A person may be listed before they create an account.

We do not warrant that listing details are complete, current, or correctly classified as office versus personal. We aim to publish professional practice contact details only. Personal, mobile, home, private, or unlisted numbers, and numbers used for identity verification, are not intended for public display.

Corrections and personal-number takedown

The listed professional or an authorised representative may request removal of a personal or mobile number, correction of professional details, or review of delisting. Email [email protected] (include the listing URL). We aim to suppress personal or mobile numbers from public pages within two business days of a valid request. We may verify identity so listings are not taken down in bad faith, but we will not keep a reported personal number public while we check.

Claimed listings

If you claim or edit a listing, you warrant that you are authorised, that the information is accurate, and that any phone number you provide is a professional practice number you are allowed to publish. You grant us a licence to display it on JamaicaMD properties.

4. User accounts

Account creation

• Provide accurate information and keep it updated
• Keep your password confidential
• You are responsible for activity under your account

Eligibility

You must be at least 18 to create an account, or use the Platform with a parent or guardian if you are booking for a minor.

5. Acceptable use

You agree not to:

• Use the Platform for any illegal purpose
• Scrape, harvest, crawl, or bulk-copy listings or personal data
• Resell or commercially exploit the directory database
• Use listing phone numbers for spam, telemarketing, harassment, or identity fraud
• Use a number from a listing for identity verification, banking, SIM registration, or similar private purposes
• Submit false claim information or impersonate a practice
• Interfere with the Platform or attempt unauthorised access
• Collect personal data from other users without permission
• Upload malware or content that is unlawful, defamatory, or infringes others’ rights

We may suspend access, remove content, and report abuse. Unauthorised use of listing data may violate data-protection, anti-spam, and computer-misuse laws.

6. Licence to use the Platform

We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Platform for its intended purpose (finding care, booking, or managing a listing you are authorised to operate). We may change, suspend, or discontinue features at any time.

7. Appointments and providers

Booking

• You enter a relationship with the healthcare provider, not with HealthTech as clinician
• You are responsible for attending or cancelling according to the practice’s rules
• We may charge disclosed booking or software fees

Provider independence

Providers are independent. We do not control clinical care, guarantee quality, or accept liability for medical outcomes.

8. Reviews and content

By submitting reviews or other content you grant us a licence to use and display it, confirm it is truthful, and agree we may remove content that is false, unlawful, or violates privacy (including other patients’ health information).

9. Privacy and no sale of data

Our Privacy Policy explains how we process personal data, including directory listings. We do not sell, rent, trade, or lease personal information. The Privacy Policy is part of these Terms. Related directory terms also appear at jamaicamd.com/terms.

You agree that we may send service notices by email, SMS (if you provided a number for that purpose), or by posting on the Platform. Marketing messages, if any, include an opt-out.

10. Disclaimers

The Platform is provided “as is”. We do not warrant uninterrupted service or the accuracy of third-party or compiled listing data, including phone numbers. Always confirm details with the practice.

11. Limitation of liability

To the fullest extent permitted by law:

• We are not liable for medical outcomes or provider conduct
• We are not liable for misclassified or outdated listing information, including a number a source treated as a practice number
• We are not liable for search-engine or third-party copies of our pages
• We are not liable for indirect, incidental, or consequential damages
• Our aggregate liability is limited to the amount you paid us in the 12 months before the claim, or USD $100 if you paid nothing

Nothing limits liability that cannot be limited under applicable law (including fraud, or death or personal injury caused by negligence where such a limit is prohibited).

12. Indemnification

You agree to indemnify HealthTech against claims arising from your use of the Platform, your content, or listing information you submit, including a phone number you were not entitled to make public, except to the extent caused by our wilful misconduct.

13. Termination

We may suspend or terminate access for breach of these Terms or to protect the Platform or others. You may close your account by contacting us. We may suppress or remove a listing to comply with a privacy request or the law.

14. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, except that: (a) if you are a data subject in Jamaica, the Jamaica Data Protection Act applies to our processing of your personal data; and (b) mandatory consumer or data-protection rights in your country of residence are not waived. Courts in Broward County, Florida have exclusive jurisdiction over disputes arising from these Terms, except where a data-protection authority or other court of competent jurisdiction must hear the matter.

15. Changes

We may modify these Terms by posting an updated version and changing the “Last updated” date. Continued use after that date constitutes acceptance except where law requires additional notice.

If a provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in a reorganisation or sale of the service. A failure to enforce a provision is not a waiver. Third-party links are not under our control. We are not liable for delays caused by events beyond our reasonable control. These Terms and the Privacy Policy are the entire agreement for use of the Platform.
